Terms of Service

These terms govern your use of Bandkick, a managed advertising service operated by Eshy Gazit LLC (d/b/a EG Management; “Bandkick,” “we,” “us”). By creating an account, submitting a campaign, or funding a budget, you agree to these terms and to our Privacy Policy.

1. The service

Bandkick plans, launches, manages, and reports on advertising campaigns on your behalf across third-party advertising platforms (including Meta, TikTok, Spotify, Snapchat, Google/YouTube, and others). You approve a campaign brief and budget; we handle setup, launch, optimization, and reporting. Some placements (for example Spotify Marquee and Showcase) are run through partner tools rather than advertising APIs and may require you to grant our team access — for Spotify, by inviting our team account to your Spotify for Artists team.

2. Fees

• Management fee — 10%. Our fee is 10% of each campaign budget you commit, deducted from the budget at launch. The remaining 90% is spent as media on the advertising platforms.
• Payment processing. Card payments are processed by Stripe. The processing cost (currently 2.9% + $0.30 per card charge) is itemized and added at checkout so your full approved budget lands in your media balance.
• No hidden charges. We charge nothing beyond the management fee and the itemized processing cost. Media spend is billed to us directly by the advertising platforms out of your funded budget.

3. Budgets, balances, and refunds

• Funded amounts are held as a media balance in your client account and drawn down as campaigns launch.
• Unspent media is returned. When a campaign completes having spent less than its committed media budget, the difference is automatically credited back to your balance.
• Balance credits can fund future campaigns, or you may request a refund of any unused balance at any time; refunds are returned to your original payment method, less processing costs we cannot recover.
• Once media has been spent with an advertising platform it cannot be refunded. The management fee for a launched campaign is earned at launch and is non-refundable.
• Spend is capped at your committed budget: our systems monitor delivery and pause campaigns that reach their budget.

4. Campaign approval and delivery

• Campaigns launch only after you approve the plan and fund the budget.
• Every advertising platform reviews ads independently and may reject, restrict, or delay them. We will revise and resubmit where practical, but platform decisions and timing are outside our control.
• We may make reasonable adjustments within your approved plan (bids, placements, scheduling, creative variations) to improve delivery. Material changes to budget or channels require your approval.
• We do not guarantee specific results — streams, followers, sales, or any other outcome. Advertising performance depends on factors outside anyone’s control.

5. Your content and creative

• You confirm you own or control the rights to everything you provide — music, artwork, photos, video, names, and likenesses — and you license us to use it to create and run your campaigns.
• We may produce creative for your campaigns, including AI-assisted images, video, and voiceover derived from your assets and brief. Generated creative is presented for review, and anything we publish runs under your approved campaign. Rights in creative we produce for you are assigned to you once the related fees are paid.
• You are responsible for ensuring your campaigns comply with the law and with each platform’s advertising policies. We may decline or stop any campaign we reasonably believe is unlawful, infringing, or misleading.

6. Accounts and acceptable use

Keep your login credentials confidential; you are responsible for activity under your account. You may not use Bandkick to promote unlawful content, infringe others’ rights, or circumvent advertising-platform rules.

7. Termination

You may stop using Bandkick at any time; pausing or cancelling a campaign stops future spend, and Section 3 governs what happens to your balance. We may suspend or end service for breach of these terms, with any unused media balance returned to you.

8. Disclaimers and liability

The service is provided “as is.” To the fullest extent permitted by law, we disclaim implied warranties, and our total liability for any claim arising out of the service is limited to the management fees you paid us in the three months before the event giving rise to the claim. We are not liable for indirect or consequential damages, or for the acts, policies, or outages of third-party advertising platforms.

9. General

These terms are governed by the laws of the State of New York, and disputes belong to the state or federal courts located in New York County. If we update these terms we will post the new version here with a new date; continued use after a change is acceptance. These terms plus your approved campaign briefs are the entire agreement between us.
